UPDATE: No charges to be filed in fatal UTV crash in Buchanan County

No charges will be filed against the father who was operating a utility terrain vehicle Sunday that crashed in Buchanan County, Virginia. The man's 7-year-old son was killed as a result of injuries sustained in the wreck, according to the Virginia State Police. (MGN)

The driver in a utility terrain vehicle crash in Buchanan County crash over the weekend that killed his son will not be charged, the Virginia State Police reported Tuesday.

The 30-year-old driver, who the VSP reported was from Warren County, Virginia, was traveling on Route 647 on Sunday just after 4 p.m. in the UTV that ran off the right side of the road, struck a utility pole and went over an embankment.

The crash ejected the man's 7-year-old from the vehicle. The child was taken to a Grundy hospital where he succumbed to his injuries, the State Police reported. The man's other child. a 3-year-old boy, received minor injuries.

The decision not to issue charges in the case was made following a consultation with Buchanan County Commonwealth's Attorney Gerald Arrington.
